RAFFALL TERMS & CONDITIONS
COMPETITION HOST — TERMS & CONDITIONS The Alocasia Company Ltd Effective date: 25 June 2025
These terms govern the relationship between you (the entrant) and The Alocasia Company Ltd (the Host) in relation to competitions we operate via the Raffall platform. They should be read alongside Raffall's own Terms & Conditions, which take precedence on matters relating to the platform itself. By entering any of our competitions, you agree to be bound by both sets of terms.
1. ABOUT THE HOST
The Alocasia Company Ltd (referred to in these terms as "the Host", "we", "us" or "our") operates prize competitions via the Raffall platform (www.raffall.com). We are a UK-based business specialising in rare and exotic Alocasia plants.
If you have any questions about these terms or a competition we are running, please contact us:
The Alocasia Company Ltd
Email: sales@thealocasiacompany.co.uk
Address: 93-95 Wallasey Road, Wallasey, Wirral, CH44 2AQ
2. THE RAFFALL PLATFORM
All competitions we host are run through Raffall Limited (company no. 09930826), 7 Bell Yard, London WC2A 2JR. By entering any of our competitions, you are also subject to Raffall's Terms & Conditions, available in full at www.raffall.com/terms.
Although the word "raffle" may be used in marketing materials, all competitions on the Raffall platform include a free postal entry route and are therefore legally classified as Prize Competitions — not raffles — and are not governed by the Gambling Act 2005. The promoter of all competitions on the platform is Raffall Limited.
3. ELIGIBILITY TO ENTER
To enter any of our competitions, you must:
- Be aged 18 or over
- Be a registered user of the Raffall platform with a verified email address
- Not be physically located in a jurisdiction where entering prize competitions of this nature is unlawful at the time of entry
The following people are not permitted to enter:
- Members of the Host's immediate family or household
- Employees, agents or associates of Raffall Limited or its subsidiaries
- Any person otherwise excluded under Raffall's Terms & Conditions
By entering, you confirm that you meet all eligibility requirements. We reserve the right to require proof of eligibility and to disqualify any entry that does not comply.
4. HOW OUR COMPETITIONS WORK
4.1 Entry
Competitions run from the Opening Date to the Closing Date as set out in the competition details on Raffall. You may enter by:
- Purchasing tickets via the Raffall platform using a debit/credit card or Raffall Credit; or
- Submitting a free Postal Entry in accordance with Raffall's postal entry conditions (details available on the Raffall platform)
All ticket sales are final and non-refundable. Joint entries are not permitted and entries may not be submitted on behalf of another person.
4.2 The Draw
On the Closing Date (or when all tickets are sold, whichever is sooner), a winner will be selected randomly by Raffall's automated draw system. The draw result is final. The winner's name will be published on the Raffall platform on the Draw Date in accordance with Raffall's Privacy Policy.
It is each entrant's responsibility to check the Raffall platform to confirm whether they have won. Winners are not contacted separately — winning tickets are displayed in the 'Your Tickets' section of your Raffall account. We may, at our discretion, also attempt to contact a winner by telephone if a number has been provided.
5. THE PRIZE
The prize for each competition is set out in full in the competition details on the Raffall platform. The prize is as described and is not negotiable, transferable or exchangeable for cash or any other alternative, unless otherwise stated.
As the Host, we warrant that:
- We have full legal title to the prize and the right to offer it as a competition prize
- The prize is accurately described in the competition listing
- We will fulfil our obligation to transfer or deliver the prize to the winner in accordance with these terms and Raffall's Terms & Conditions
5.1 Prize Confirmation
Within 7 days of the competition ending, we will confirm the prize status via our Raffall account. If we fail to do so within this period, the prize will automatically be deemed revoked under Raffall's rules and we will forfeit payment of the Host's Proceeds.
Where a minimum ticket target was set but not met, we will choose between providing the prize as advertised or offering the winner 50% of ticket revenue. Our decision will be made in good faith and communicated promptly.
5.2 Delivery and Collection
Unless otherwise stated in the competition listing, the cost of delivery is not included in the prize. We will communicate directly with the winner to arrange delivery or collection and will retain all relevant receipts as proof of fulfilment.
Where a physical exchange is required, both we and the winner are responsible for confirming acceptance of the prize on the Raffall platform at the time of exchange.
6. CLAIMING THE PRIZE
Winners must claim their prize by pressing the 'Claim' button on their winning ticket within 21 days of the Draw Date. We will communicate promptly with the winner once we receive their contact details via Raffall to arrange prize fulfilment.
The prize cannot be claimed by a third party on the winner's behalf. If the winner is unable or unwilling to take up the prize within the permitted timeframe, we accept no responsibility for any resulting loss.
7. ACCEPTANCE AND DISPUTES
The winner has 21 days from the Draw Date to accept or dispute the prize via the Raffall platform.
- Acceptance: By pressing 'Accept', the winner confirms that the prize is as advertised and that they have taken possession. On acceptance, the winner's rights to dispute are extinguished and our Host's Proceeds will be released.
- Dispute: By pressing 'Dispute', the winner asserts that the prize is not as advertised or has not been received. The matter will be investigated by Raffall's Disputes Team, whose decision is final and binding on all parties.
If a dispute is upheld in the winner's favour, the winner will receive compensation of 75% of the Total Proceeds as per the Raffall Guarantee. If the winner neither accepts nor disputes within 21 days, the prize is deemed accepted and our Host's Proceeds will be released automatically.
8. OUR OBLIGATIONS AS HOST
As Host, The Alocasia Company Ltd commits to:
- Providing a prize that is accurately described and legally owned by us
- Acting in good faith and in compliance with these terms and Raffall's Terms & Conditions at all times
- Communicating with the winner promptly and professionally to arrange prize fulfilment
- Confirming prize status within 7 days of the competition closing
- Retaining proof of prize delivery or collection
- Not offering cash, bank transfers, gift cards or a share of ticket revenue as a substitute for the advertised prize
- Complying with all applicable UK laws and regulations
9. ACCEPTABLE CONDUCT
All competition participants are expected to behave in a respectful and lawful manner. Unacceptable behaviour includes, but is not limited to:
- Threatening, abusive or insulting language directed at any participant or Raffall staff
- Harassment, intimidation or cyberbullying
- Any conduct likely to cause damage, nuisance or injury to any party or their property
- Any attempt to manipulate, defraud or circumvent the competition process
We reserve the right to disqualify any participant whose conduct is contrary to the spirit of the competition or these terms.
10. FEES AND SERVICE CHARGES
Raffall's service charges and any applicable fees are deducted from the Total Proceeds in accordance with the rates set out on Raffall's Fees & Subscriptions page. Our Host's Proceeds represent the Total Proceeds less Raffall's Service Charges, any applicable Affiliate Commission, and any charitable donation we have pledged.
11. CHARITABLE DONATIONS
Where we have agreed to donate a portion of the Host's Proceeds to a named charity or cause, full details — including the percentage pledged — will be set out in the competition listing. Raffall will arrange for the relevant funds to be paid directly to the nominated charity, deducted from our Host's Proceeds.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law:
- We accept no liability for any loss, damage, injury or inconvenience suffered by any entrant or winner arising from their participation in our competitions, except where directly caused by our own negligence or wilful misconduct
- We are not responsible for the conduct, decisions or systems of Raffall Limited, which operates independently as the platform provider and promoter
- We accept no responsibility for postal delays, lost entries, technical failures on the Raffall platform, or any Force Majeure Event beyond our control
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Your statutory rights are not affected.
13. INTELLECTUAL PROPERTY AND PUBLICITY
All images, descriptions and content we submit to Raffall for competition listings are either owned by The Alocasia Company Ltd or used with appropriate permission, and do not infringe the rights of any third party.
By hosting on Raffall, we grant Raffall a non-exclusive, worldwide licence to use, display, copy and publish our competition content for the purposes of running and promoting competitions on their platform. Raffall may also use our name, image or likeness in connection with competition publicity for up to 5 years from the Competition End Date, in accordance with their Terms & Conditions.
14. DATA PROTECTION AND PRIVACY
We will handle any winner personal data provided to us by Raffall (including name, email address and telephone number) solely for the purpose of fulfilling the prize. We will not use such data for any unrelated marketing purpose, share it with any third party, or retain it longer than necessary.
Our processing of personal data is governed by applicable UK data protection legislation, including the UK GDPR and the Data Protection Act 2018. Participants' personal data is also processed by Raffall in accordance with their Privacy Policy at www.raffall.com/privacy.
15. CHANGES, CANCELLATION AND FORCE MAJEURE
We reserve the right to amend or cancel a competition where circumstances beyond our control make it necessary or impossible to proceed, acting in accordance with Raffall's Terms & Conditions regarding prize and ticket revenue obligations.
Raffall also independently reserves the right to cancel, void, suspend or amend any competition at any time. Where cancellation is made by Raffall, we accept no further liability to entrants.
Where a Force Majeure Event prevents prize fulfilment, we will be entitled to a reasonable extension of time. If delay continues for 4 or more weeks, Raffall may terminate the competition and handle any prize or ticket revenue in accordance with their rules.
16. GENERAL PROVISIONS
16.1 Entire Agreement These terms, together with the competition listing and Raffall's Terms & Conditions, constitute the entire agreement between us and participants in relation to our competitions.
16.2 Severance If any provision of these terms is found to be invalid, illegal or unenforceable, that provision shall be deemed deleted without affecting the validity of the remaining terms.
16.3 No Waiver Failure by us to exercise any right under these terms shall not constitute a waiver of that right.
16.4 Third Party Rights These terms do not create any rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999.
16.5 Governing Law and Jurisdiction These terms shall be governed by and construed in accordance with the law of England and Wales. All parties submit to the exclusive jurisdiction of the courts of England and Wales in relation to any dispute arising out of or in connection with these terms.
